1. ACCEPTANCE OF TERMS

By accessing or using the Souk Watani website, mobile application, or services (collectively, the "Platform"), you agree to comply with and be bound by these Terms of Use. These terms constitute a legally binding agreement between you and Souk Watani, governed by the Electronic Transactions Law (Royal Decree No. 39/2025) of the Sultanate of Oman.

2. THE MARKETPLACE MODEL

Souk Watani operates as a multi-vendor marketplace. We provide a digital venue that allows independent third-party sellers ("Vendors") to list and sell their products.

• Intermediary Role: Souk Watani is an intermediary platform. The contract for sale is formed directly between the Buyer and the Vendor.
• International Use: While we are based in Oman, our platform is accessible internationally. Users outside of Oman are responsible for compliance with their local import laws and customs regulations.

3. USER ELIGIBILITY AND ACCOUNTS

• Legal Capacity: You must be at least 18 years of age or have legal parental consent to use this Platform.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials. All activities under your account are your sole responsibility.
• Accuracy: Users must provide true, accurate, and current information as required by the Oman Ministry of Commerce, Industry, and Investment Promotion.

4. VENDOR OBLIGATIONS

Vendors using the platform agree to:

• Hold all necessary licenses and Commercial Registrations (CR) required by Omani law.
• Provide accurate product descriptions, clear pricing, and high-quality imagery.
• Adhere to the Oman Consumer Protection Law regarding product quality and warranties.
• Prohibit the listing of items that violate Islamic values, Omani public morals, or Sultanate regulations.

5. PAYMENTS AND TAXATION

• Currency: All transactions are processed in Omani Rials (OMR) unless otherwise stated.
• VAT: In accordance with the Oman Tax Authority, a 5% Value Added Tax (VAT) may be applicable to purchases. This will be displayed at checkout.
• Processing: Payments are handled through secure, PCI-compliant third-party gateways authorized to operate within the Sultanate.

6. CONSUMER RIGHTS AND RETURNS

In alignment with Royal Decree No. 66/2014 (Consumer Protection Law):

• Right to Refund: Customers have the right to replace or return a product if it is found to be defective or does not conform to the agreed-upon specifications.
• Dispute Resolution: In the event of a dispute between a Buyer and Vendor, Souk Watani will provide a mediation service, but the final liability remains with the Vendor.

7. PROHIBITED CONDUCT

Users are strictly prohibited from:

• Using the platform for fraudulent purposes or money laundering.
• Infringing upon the Intellectual Property rights of Souk Watani or its Vendors.
• Posting content that is defamatory, obscene, or harmful to the national security of Oman.
• Attempting to circumvent the Platform's payment systems to avoid commission fees.

8. DATA PRIVACY

Your use of the Platform is also governed by our Privacy Policy, which complies with the Omani Personal Data Protection Law (Royal Decree No. 6/2022). We process your data only with your consent and for the purposes of facilitating your transactions.

9. LIMITATION OF LIABILITY

Souk Watani shall not be held liable for any damages, loss of profits, or data arising from:

• The quality, safety, or legality of items advertised by Vendors.
• Interruptions in service due to technical failures or force majeure.
• Unauthorized access to your account by third parties.

10. GOVERNING LAW AND JURISDICTION

These Terms of Use shall be governed by and construed in accordance with the Laws of the Sultanate of Oman. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the Courts of Oman.

11. AMENDMENTS

Souk Watani reserves the right to modify these terms at any time. Significant changes will be communicated via the Platform. Continued use of the site following such changes constitutes your acceptance of the revised terms.
